I'm a First Time Offender, What Should I Do?
- Don't panic. Contact a qualified DWI / DUI Attorney. Call Jim Medley!
- Rely on Attorney Medley to keep you informed of your rights and responsibilities.
- A hearing must be requested within 15 days of your arrest date or you will be subject to a driver's license suspension of 90 days (if you failed the breath or blood test) or 180 days (if the test was refused). The suspension can be more strict if you are under 21 years of age, or if you have prior DWI convictions.
- When Attorney Medley has received your video, other evidence and reports, he will schedule a time to review the material with you.
- Following that meeting, Attorney Medley will explain the strength of your case and your options. Ultimately you will decide the direction to take.
- There will be multiple court appearances; the case may last for months, particularly if the case is set for trial.
- Court Dates/Hearings/Appointments Being charged with the offense of DWI is a serious legal matter and your personal appearance for all other court dates and hearings is mandatory. An unexcused failure to appear may result in:
- the loss of the right to a speedy trial
- subject you to an additional citation for that offense
- result in forfeiture of bail
- the issuance of a warrant for your arrest
- and/or loss of your privilege to drive
Unless Attorney Medley instructs you otherwise, you will not need to attend your license hearing at the State Office of Administrative Hearings.
- 8. Do not discuss your case with anyone, including the police, other than Attorney Medley until it is finalized in court.
- 9. Do not attempt to contact any witness listed to testify against you without consulting Attorney Medley first.
